Ebook Bike is based in Canada, but follows the guidelines of the US Digital Millennium Copyright Act of 1998 known commonly (and here further) as the "DMCA" you may read it in it's entirety here. Our obligation under the DMCA is to remove any content uploaded improperly to our website within 72 hours of recieving a proper notice. As many copyright holders have failed to properly provide the information required by the DMCA we have made this tool to ensure every request comes with the proper information. In exchange for copyright holders using this form to file their take-down requests we instantly process them in good faith.
Our take-down system goes above and beyond our requirements in every jurisdiction we can find and we actively work to ensure that copyright holder's rights are upheld. YouTube, Facebook, Twiter, Flickr, Google and every other major company manually reviews DMCA requests and can take up to 72 hours to respond.
The DMCA requires a letter, by submitting the following form you are digitally signing the following letter:
This letter is official notification under Section 512(c) of the Digital Millennium Copyright Act (”DMCA”), and I seek the removal of the aforementioned infringing material from your servers. I request that you immediately notify the infringer of this notice and inform them of their duty to remove the infringing material immediately, and notify them to cease any further posting of infringing material to your server in the future.
Please also be advised that law requires you, as a service provider, to remove or disable access to the infringing materials upon receiving this notice. Under US law a service provider, such as yourself, enjoys immunity from a copyright lawsuit provided that you act with deliberate speed to investigate and rectify ongoing copyright infringement. If service providers do not investigate and remove or disable the infringing material this immunity is lost. Therefore, in order for you to remain immune from a copyright infringement action you will need to investigate and ultimately remove or otherwise disable the infringing material from your servers with all due speed should the direct infringer, your client, not comply immediately.
By submitting this agreement, I realize that my IP address will be recorded and a cookie will be placed on my computer to track abuse and also help me auto-fill out the forms below. False takedown requests will result in a $150 fee as allowed by the DMCA, a ban will also be placed on my ability to remove content automatically until the $150 fee is paid.
I am providing this notice in good faith and with the reasonable belief that rights my company owns are being infringed. Under penalty of perjury I certify that the information contained in the notification is both true and accurate, and I have the authority to act on behalf of the owner of the copyright(s) involved.
The DMCA requires us to collect the following information, to ensure if a counter claim is made against any work we may contact you before putting the work back up. We save this data on your computer so further requests do not have to be manually filled out.
